PLEASE READ THOROUGHLY!
Guests have agreed to rent a private property for good and valuable consideration and hereby covenants and agrees to the following:
DEPOSITS: A valid credit card number and deposit is required for all reservations. American Express, Visa, MasterCard, Discover or Diners Club cards are accepted. A signed contract and an initial deposit of 25% of total rent is required to secure the reservation.
RENT: Full rent, taxes and fees are due 30 days prior to arrival for all properties. The balance due must be paid in US funds and will be charged to your credit card automatically unless advised otherwise. If your payment is not received by the due date, your reservation will be subject to cancellation. Please note that the name on the reservation must match name on credit card given for payment.
MINIMUM STAY REQUIREMENTS: Typically, there is a 5 to 7-night minimum stay for homes and a 3 to 5-night minimum stay for condos. During the holiday period, there is a 14-night minimum stay for all home bookings and a 7-night minimum stay for all condos.
OCCUPANCY: The number of guests is restricted to the number described. Additional guests must be disclosed and approved. Weddings, receptions, parties, or functions are not permitted. Any use of a rental property for other than strictly family vacation purposes or any non-permitted occupants may result in the termination of this contract and eviction from the premises.
DAMAGE PROTECTION: Guests are responsible for any damage to the rental property caused by you or your party during your stay. You must purchase Vacation Rental Damage Protection designed to cover unintentional damages to the rental unit that occur during your stay provided they are disclosed to management prior to check-out. The program will pay a maximum benefit depending on coverage. Any damages that exceed the limit or are not covered under the program will be charged to the credit card on file. TRAVEL INSURANCE: You have been advised to secure travel insurance to cancel your trip due to a covered event (including but not limited to mandatory evacuation at the property due to adverse weather or natural disaster).
CANCELLATIONS: You have the right to cancel with 30 days’ written notice. With timely cancellation notice, all advance funds will be returned less a cancellation fee within 24-48 hours. Cancellation fees are $150 for condos and $250 homes. Bookings made within the 30-day cancellation period are non-refundable. Some promotions require full payment at time of booking and are nonrefundable. To avoid any cancellation fees with over 30-day notice period, you may move your dates forward within 365 days from original date of arrival, crediting the full booking amount towards the new booking total.
If written notice is received less than 30 days, all advance funds will be forfeited unless we can rebook your rental dates. No refunds will be given for early departure as you are responsible for the entire time booked once within the non-cancellation period. Due to the fact that our properties are individually owned, we reserve the right to relocate you in an unforeseen circumstance such as the sale of the unit, a maintenance concern or owner usage, and if necessary, cancel your reservation. Our best efforts will be to move you to a comparable property, but it is not guaranteed.
For those who booked with us via an online travel agent or other third-party travel professional, please contact them for information on their cancellation policies as they may differ.
CHECK-IN TIME: Standard times are 3:00 PM for condos and 4:00 PM for homes. Upon availability, early check-in can be guaranteed for an additional 50% of the daily rate + tax.
CHECK-OUT TIME: Standard check-out time is 10:00 AM. Upon availability, a late check-out may be granted at an additional charge of 50% of the daily rate + tax up to 6:00 PM. After 6:00 PM a full day charge may apply.
ACCOMMODATIONS: The information while deemed reliable is not guaranteed. Properties offered for rental are individually and privately owned and reflect the tastes of each owner. Distances to the beach are approximate. Every effort has been made to assure accurate descriptions. Not all accommodations have central air conditioning – please check property description for specific details. Changes in inventory or items and/or decor occur from time to time and such changes will not void or alter the terms of the rental agreement. The Parrish Collection Kauai will not be held responsible for noise or loss of view due to construction or for any amenities which are closed for maintenance purposes or inoperable conditions. Guests must abide by house rules as provided.
ENVIRONMENTAL DISCLOSURE: Guest acknowledges that the State of Hawaii is exposed to environmental hazards including, but not limited to: tidal waves, hurricanes, severe storms, and flooding. Please refer to the Guest Compendium in your property for information pertaining to evacuation procedures from the property. In the event of an emergency, the State of Hawaii utilizes a siren warning alert system (please note that emergency sirens are tested on the first working day of every month at 11:45 a.m.). Guest is responsible for using their best efforts to familiarize themselves with the property, its location, its surroundings, as well as applicable evacuation procedures.
SECURITY OF THE HOME AND RENTAL EQUIPMENT: When you rent a property, you assume full responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave. Lock your automobiles and put away any rental equipment. Any use of rented equipment by the guests is strictly at your own risk, liability and could cause you to incur additional expenses.
CLEANING: Your property will be expertly cleaned prior to your arrival, and again after your departure. Excessive departure cleaning, if necessary, will be charged to your credit card and is not covered by the Vacation Rental Damage Protection Program. Daily maid service or a mid-stay clean is included at some properties. Additional housekeeping services are available upon request for an additional fee.
MAINTENANCE AND REPAIRS: We make every effort to ensure that all equipment within each rental is in working order. In the event of a breakdown, we will strive to repair it as soon as possible after being notified of a problem. We cannot guarantee that spas, air conditioners, televisions, appliances, high speed internet access, etc. will not break down during your stay and therefore, no refunds or adjustments will be made for mechanical failure. Furthermore, there will be no refunds or adjustments made for any other unexpected situation beyond our control such as bugs, rodents, roosters, frogs, weather, and the like.
LOCK-OUT/LOST KEY POLICY: In the event a guest is locked out of the property during the rental period, the guest may borrow a key by coming to the office. After business hours, guests must call 808.634.8544 for assistance. There is a $50-100 charge for a lost property key or pool key.
MISCELLANEOUS POLICIES, CONDITIONS & WAIVERS:
- All rates and fees subject to Hawaii State of General Excise Tax (GET) of 4.72%; Transient Accommodation Tax (TAT) of 10.25%, and a County of Kauai Transient Accommodation Tax (Kauai TAT) of 3%.
- Guest is not renting the Property for a public purpose that involves admission of the public.
- Guest booking reservation must be 25 years of age or older.
- All properties are designated non-smoking by Hawaii State law and we do not allow pets. Violation of this will result in a detoxification charge equal to one night’s rent.
- Rates and amenities are subject to change without notice.
- Upon departure, follow specific instructions in your “arrival letter” for key return.
- High speed Internet service may be available at select properties, however The Parrish Collection Kauai is not responsible for service provider connectivity, technical support, or equipment failure.
- Open fires and fireworks are prohibited at all times.
- Guest hereby acknowledges that the ocean and pools are inherently dangerous, and use can result in serious injury or death.
- Guest acknowledges that lanais and lanai railings are potentially dangerous if improperly used, particularly with regard to children, who may not appreciate the potential risks involved.
- Guest acknowledges that the Property may be equipped with bicycles and/or other sports equipment. Guest acknowledges that using these items may be potentially dangerous if done improperly or by inexperienced persons.
- While Kauai is a safe place, please lock all doors and windows when not in residence and we highly suggest that all windows and doors remained closed and locked whenever possible.
GUEST HEREBY WAIVES AND RELEASES ANY CLAIMS AGAINST OWNER, OWNER’S RENTAL AGENT, SUCCESSORS, ASSIGNORS, EMPLOYEES OR REPRESENTATIVES, OFFICIALLY OR OTHERWISE, FOR ANY INJURIES, ILLNESSES OR DEATH THAT MAY BE SUSTAINED BY GUEST ON OR NEAR OR ADJACENT TO THE PROPERTY, INCLUDING THE FACILITIES. GUEST AGREES TO USE THE FACILITIES ENTIRELY AT THE GUEST’S OWN INITIATIVE, RISK, AND RESPONSIBILITY. GUEST ASSUMES SOLE RESPONSIBILITY FOR PERSONAL PROPERTY OF GUEST AND THOSE PERSONS CLAIMING UNDER GUEST.
Guest acknowledges and agrees that Guest will be responsible for and will assume the risk for any of Guest’s minor family members, guests, or invitees that use the Facilities. Guest hereby agrees to supervise any children, non-swimmers, individuals with physical or mental deficiencies, and all others using the Facilities and to take full responsibility for their supervision.
Guest agrees to defend, indemnify and hold harmless the Owner, Owner’s rental agents, and their respective successors, assigns, employees or representatives, officially or otherwise, for any damages, costs, expenses, attorneys’ fees, incurred by Owner, Owner’s rental agents, and their respective successors, assigns, employees or representatives due to any claims relating to injuries or death that may be sustained by guests on or near or adjacent to the Facilities during the Rental Term.
This legal instrument may be pleaded as a complete defense to any action or other proceeding, which may be brought, instituted or taken by the undersigned, the undersigned’s family, other Guest invitees or Property users, in breach of this instrument. If any provision of this form is declared invalid or unenforceable, the remaining portions of this form shall not be affected thereby and shall be fully enforced.
This Agreement shall be binding upon the heirs, personal representatives, executors, administrators, successors and assigns of the undersigned.
